Hate speech is defined as public speech that expresses hate or encourages violence towards a person or group based on something such as race, religion, sex, or sexual orientation. It depends on what the government defines as hate speech. Sometimes what people say can be misinterpreted. But if it's blatant hate speech, then no it shouldn't.

No, and increase penalties for hate speeches against police, race/ethnicities, sexual orientations, and religions (Blackcraft Cult is okay). The Freedom of Speech laws should only protect you from criticizing the government.
