Should local law enforcement be allowed to detain illegal immigrants for minor crimes and transfer them to federal immigration authorities?

On October 7, 2013 California Governor Jerry Brown signed a state bill prohibiting law-enforcement officials from detaining an individual on the basis of a U.S. Immigration and Customs Enforcement hold after that person becomes eligible for release, unless he or she has been charged with or convicted of certain crimes, including violent felonies.

I think that it is only fair for illegal immigrants involved in minor crimes to be referred to authorities.

Yes, the punishment for illegal immigration should be execution.

A one week amnesty chance where they will simply be deported to their country of origin first. Should they not take this benevolent opportunity, a few executions to show we're serious should be enough to convince most to leave of their own accord. Exceptions for victims of human trafficking, where deportation is acceptable.

If someone commits a crime which falls under State jurisdiction due to it's nature, then it should be handled by the State. If it is a federal crime, then it should be prosecuted by the federal government. But a persons immigration status, while it can be a federal offense, should have no impact on the fair trial or treatment of the accused simply.

Sometimes these immigrants dont have the money to buy themselves essentials and if they really need it they should have a bit of compassion

Yes, illegal immigrants should be handed over to federal authorities and deported but there should be a simple path to citizenship for illegal immigrants with no criminal record.

I think "deported" is a strong word and they should be put in jail like everyone else.

No, only if convicted of a violent crime. Law enforcement should have the ability to report to the federal government but not detain them

The House of Representatives passed a bill on Thursday in honor of Laken Riley, the Georgia nursing student who was slain last month by an illegal immigrant.The bill would require federal immigration authorities to detain illegal immigrants charged with local theft or burglary and would also allow states to sue the federal government “if an immigration related action harms the state or its citizens.” The passage of the Laken Riley Act in a 251-170 vote comes weeks after Jose Antonio Ibarra, an illegal immigrant from Venezuela was charged in the 22-year-old’s murder on the University of Georgia campus.Ibarra, who illegally entered the country in September 2022 and was released into the U.S. via parole, was arrested in New York City in September 2023 for acting in a manner to injure a child under 17, but he was released by local police before a detainer could be issued. One month later, he was cited in Georgia for misdemeanor shoplifting alongside his brother, Diego Ibarra, the Atlanta Journal-Constitution reported. Republicans have decried the immigration policies that allowed Ibarra to be on the school’s campus that morning to carry out what police called a crime of opportunity as the pair did not appear to know each other.Thirty-seven Democrats joined every Republican in attendance in voting in favor of the bill.“The senseless murder of Laken Riley by Jose Ibarra, who had no business being in this country, was another wake-up call as Americans experience an illegal alien crime wave because of Joe Biden’s open border and local sanctuary city policies,” Representative Mike Collins (R., Ga.) told Fox News.
