Marital rape is nonconsensual sex in which the perpetrator is the victim's spouse. Marital rape was not criminalized by many countries until the mid-nineteenth century. In 1993 the U.N. designated marital rape as a human rights violation. Marital rape is illegal in Australia, Canada, Ireland, England, Germany, France, Italy, Spain, Brazil. Marital rape is not a criminal offence in China and India.

Yes the law criminalizes all forms of rape of men or women, including spousal rape, but unlike other rapes is not a “public crime”.
@9LVS53HRepublican3wks3W
Rape is rape, no matter if it wasn't severe or not, it was still rape. So it should be under severe violence.
@9KM6ZWF2mos2MO
Martial Rape and Non-Martial Rape should be punished differently because people can lie about Rape, profit off of the lawsuits, and make the other persons life more miserable. However, this doesn’t mean that Martial Rape doesn’t happen. I think that someone who files for martial rape should have at least a bit of evidence of such a thing happening before they start the lawsuit
@9GYX2F66mos6MO
I think it depends on the age. If y'all are both the same age or at least a year difference, with consent it shouldn't be punishable until it's actual rape. If I am 18 and my 17 year old girlfriend gave me consent to have sex with her is shouldn't have to spend time in jail. But if someone was 18 having sex with someone 13-15 then yes, that's statutory rape.
@ISIDEWITH8yrs8Y
Yes, and consentual sex with a spouse under the age of 18 should be classified as statutory rape

If you are married it changes the whole story, yes there should still be rules on it but if they are married it is there’s and there’s only.

@9GZD33M6mos6MO
There are so many men out in the world that have been accused of rape and sent to jail with no evidence. Women have a very powerful voice in this generation. It can ruin a man's life within an instant. There should be cases with the two individuals that don't cause the man to go straight to jail right away.

I hope you eventually find your way out of this misogynistic incel pipeline...

Many men in the United States have been accused of Rape and are truly innocent. Men can have their own lives ruined just by the accusations and commit suicide because of this
@9G8LK62Libertarian7mos7MO
Forced sex is rape and it is inexcusable not only in the eyes of the government and the public but also inexcusable in the eyes of god
@ISIDEWITH8yrs8Y
No, it should be classified as domestic violence
@9LXLJ2H3wks3W
It does not matter the marital status of someone, if they are raped, their abuser should be charged the same.
@9LVS53HRepublican3wks3W

@9LR88LMProgressive4wks4W
Forcing youself on someone, in a sexual way, should be classified as rape. Even if you are married it does not change the fact that you can rape your partner. marriage does not equal consent.
@9J8BM89Republican 4mos4MO
Rape is rape. Regardless of your relationship with your partner. There should always be consent in marriage. Boundaries must be respected. It is dehumanizing to reduce marital rape to a domestic violence position just because they are married. Put yourself in the position of the victim. How would you feel your rape is less important than someone else just because you were married?
@ISIDEWITH8yrs8Y
No, marriage provides legal subordination for a spouse to have sex with the other spouse
@9BK8TXW 1yr1Y
who the hell would agree to this? (who isn't trolling)
Not enough knowledge to make an informed vote
@8ZRCRS92yrs2Y
Yes, but this should be determined at the state and local level
@599YBF24yrs4Y
Marital rape should count as two offences (spouse abuse and rape).
@59G52LTRepublican4yrs4Y
No, it's your fault you married the man
@8SLKCY73yrs3Y
how the hell was she supposed to know she was going to get raped?
@93RV8TZ2yrs2Y
You are a civil terrorist.
You’re a threat to the well being of victims.
@9MKS2G616hrs16H
No, it's not her fault. Here are some scenarios and reasons as to why:
1. Arranged marriages without the person's choice are still at large, so the person in this situation has no say as they have been psychologically manipulated
2. The man in this situation may have done that in the past, but has been psychologically manipulative and made her believe that it was her fault
3. The man may have been waiting until marriage to do that
4. Lets say hypothetically, you were a woman. How would you feel if one day, your partner raped you and got you pregnant to either satisfy his urges or to trap you in an abusive marriage?
Regardless of the reason/scenario, it's still the perpetrators fault, and not the fault of the victim. Rape is rape, no matter the gender or relation to the victim.
@59C74F44yrs4Y
No non marital rape is more of a heinous crime
@5BY8M8W4yrs4Y
Yes. But in case a married person declines having sex with their spouse, after a set amount of time ( for example 6 months ), the spouse would have the right to file for divorce without having to pay mortgage. Also, in case married person declines having sex with their spouse and this leads to the spouse having extra-marital affairs, this could not be grounds for divorce or legal persecution.
@5BP37LB4yrs4Y
Marital rape should be punished even more severely than non-marital rape.
@592WL5S4yrs4Y
Yes. Rape is a crime, no matter the relations of the victim and the rapist.
@5BPWQDH4yrs4Y
Who decides whether it is rape? If there is unassailable evidence that it is rape (e.g., unaltered video showing intent and action), only then should it be treated as rape.
@992L37C1yr1Y
Rape in any instance should be considered a felony
@592MYPC4yrs4Y
Yes, but the bar for proving there was no consent should be much higher
@585W43RLibertarian4yrs4Y
Yes, just because two adults are married doesn't mean they automatically consent towards any sexual activity at any time of the day. If it quacks like a duck, walks like a duck, and eats like a duck, it's a duck.
@58ZG4RD4yrs4Y
No because some spouse's use this excuse to trap there other spouse as a form of blackmail,or do it in spite or revenge.
@592V4X74yrs4Y
Yes, classify it as domestic violence and decriminalize consentual sex with a spouse under the age of 18
@8WDCHBN3yrs3Y
“decriminalize consentual sex with a spouse under the age of 18”
Does that mean decriminalize pedophilia, like 40&16 years old? Or decriminalize 17&18 years old?
@996RSPZ1yr1Y
That's sort of the issue with grey areas like this; If the court rules in favor of one decision or the other, it stands that similar decisions will result in the same. I agree with the above stance, however, and despite the risk of a large age gap going unchecked, it would probably minimize scrutiny to couples who don't need it.
@933J6CL2yrs2Y
I suppose I’d say no in most cases, as one of the primary attributes of marriage has historically and socially been about sexual consent. I’d say in the instance where the spouses are separated or one has filed for divorce, one of them is clearly trying to escape the marriage contract. These circumstances should be classified as rape.
@9CFSCL7 11mos11MO
Yes it should be punished the same. Consensual sex with a spouse under 18 should not be statutory rape though.
@DemocraticDelineatorRepublican11mos11MO
I understand your perspective, but I believe that consensual sex with a spouse under the age of 18 should be considered statutory rape. This is because individuals below the age of 18 are not yet considered to be adults and may not fully understand the consequences of their actions. For example, in certain states, the age of consent is 16, while the legal age for marriage is 18. This discrepancy could be used to exploit and manipulate young individuals into engaging in sexual activities that they might not be ready for. What do you think about this argument? Can you provide a counterargument or solution to address the potential issues related to the age of consent and marriage laws?
Yes, should be classified as statutory rape and domestic abuse/violence.
